1. Accepting the terms
By using a kiosk, MyClub on Zalo, the photo page, the management app, or the myclub.vn website, you agree to these Terms, the Privacy Policy, and the Sales Policy (when you buy services or goods). In these Terms:
- Guest: a person who takes photos at a kiosk or uses MyClub on Zalo.
- Store: store owners, chain owners, and staff who operate kiosks on MyClub.
- Frame creator: a guest or store that designs and uploads a frame.
2. Account
- Registration details must be accurate and belong to the person registering.
- You are responsible for keeping your password, verification codes, and login devices secure.
- The store is responsible for staff accounts, counter PINs, and every action done with those accounts. Lock an account when a staff member leaves.
- Do not use another person’s account or phone number.
3. Using the kiosk
- Use the kiosk as directed on screen and by staff. Do not take apart or tamper with the kiosk hardware or software.
- The store decides and is responsible for prices, frames, shooting time, and print quality. Payment rules are in the Sales Policy.
- Only photograph people who agreed to be photographed. Guests under 16 need consent from a parent or guardian (see Privacy Policy).
- The store posts a notice that cameras are in use and shows its data processing notice on the kiosk.
4. Photos taken by guests
- The photos belong to you and the people in them. You allow the store and MyClub to store, process (add frames, edit, print), and show the photos to you during the retention period, only to provide the service.
- The store only posts photos on its page or uses them for advertising with your separate consent, in accordance with the Civil Code on image rights.
- Anyone with the photo page link can view the photos from that session. You are responsible when you share the link or post photos that include other people.
- A photo of you was shared without your consent: send a takedown request.
5. User-created frames
- Opposing the State, distorting history, violating good morals and customs, or breaking Vietnamese law.
- When sharing, the frame creator grants MyClub and stores within the chosen scope a non-exclusive, free right to display and use the frame in sessions while the frame remains shared. The frame creator keeps the copyright to the design.
- The frame creator can stop sharing or delete the frame at any time. Photos already taken or printed are not affected.
- A store may decline, hide, or remove a frame from its kiosks.
6. Prohibited content
Do not create, upload, share, or print the following content through MyClub:
- Pornographic or obscene content; sensitive content involving children in any form.
- Violence, horror, incitement of hatred, discrimination by region, ethnicity, religion, or gender.
- Insulting the honor, dignity, or reputation of others; using others’ images without permission.
- Opposing the State, distorting history, violating good morals and customs, or breaking Vietnamese law.
- Infringing others’ copyrights, trademarks, or industrial designs.
- Fraud, ads for prohibited goods, malware, malicious links.
7. Intellectual property
- Cartoon and comic characters, games, logos, brands, and images of celebrities belong to their owners. Using them for business purposes requires the owner’s permission.
- Frame creators confirm they have the right to use every image, font, and character in the frame and are responsible for any complaints.
- Stores decide which frames to use on their kiosks and are responsible for getting permission when they use frames with characters or brands to charge guests.
- MyClub is an intermediary platform and does not review every frame in advance. Rights holders can send a takedown request (Copyright infringement) with evidence; MyClub removes or hides content when the request is well founded.
- The MyClub software, brand, and interface are owned by MyClub.
8. Handling violations
- Hide or remove violating content, even without a complaint if the violation is clear.
- Temporarily suspend sharing or the account after repeated violations.
- Provide information to competent state authorities when required by law.
- If your content was removed, you can respond via [email protected].
9. Limitation of liability
- MyClub works to keep the service running continuously. The service may be briefly interrupted by maintenance or incidents beyond reasonable control; planned maintenance is announced to stores in advance.
- MyClub is not responsible for a store’s equipment, supplies, or network connection; for user-created content; or for anyone with a photo page link sharing photos elsewhere.
- For stores, MyClub’s liability for compensation (if any) will not exceed the service fees the store paid to MyClub in the 3 months before the incident.
- These terms do not limit consumer rights under the law.
10. Governing law and changes to the terms
These Terms are governed by the laws of Vietnam. Disputes are first resolved by negotiation; if negotiation fails, they are resolved by a competent court in Vietnam. MyClub may amend the Terms; the effective date is shown at the top of the page, and important changes are announced to stores in advance.
